Erman Teicher is regularly involved in Out of Court Workouts and Restructurings. In the changing economic environments, it does not always make sense for a company or individual which has debt to be in a formal proceeding, such as filing for bankruptcy relief. We have the expertise to help businesses and individuals with debt determine whether an out of court process is the most effective way to deal with their financial issues. We are also able to assist creditors of entities and individuals who are engaged in out of court workouts or who seek to avoid paying a judgment. Our depth of knowledge and expertise make us well-positioned to evaluate a company’s or individual’s financial and business information. We are able to assist our debtor and our creditor clients to determine appropriate action in response to a company’s or individual’s financial problems.

The range of services provided to our clients include:

  • Analyzing the debt problems of insolvent companies and individuals
  • Analyzing the assets at risk and exemptions available to an individual judgment debtor
  • Consulting with companies and individuals with regard to bankruptcy and non-bankruptcy alternatives
  • Representing creditors’ committees in out-of-court matters including specific industry related cases, such as the automotive industry
  • Litigating disputed valuation of assets
  • Litigating matters pertaining to the validity, perfection, priority and enforcement of security interests
  • Prosecuting or defending avoidance actions (i.e., preference and fraudulent conveyance matters)
  • Negotiating and implementing out-of-court workouts, restructuring agreements and plans for payment of creditors
  • Preparation of liquidation analysis and/or asset analysis for use in settlement of claims or judgments
  • Regularly work with counsel who have obtained a judgment against a party to assist in collection
  • Conduct in-depth creditors’ examinations for collection of judgments
  • Regularly work with counsel who represent a judgment debtor to obtain settlement of the judgment
